These Terms and Conditions ("Terms") govern your use of BrianKelleyMD.com (the "Site"). The Site is owned and operated by ConMae Kelley Holdings LLC ("we," "us," "our") and is intended to provide educational information about the clinical practice and academic work of Brian P. Kelley, MD. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
The Site is a personal professional website operated by Dr. Kelley for educational, brand, and marketing purposes. It is not owned, operated, or controlled by Ascension or any other healthcare system or hospital, and content on this Site reflects Dr. Kelley's individual views and educational summaries, not official communications from any employer or affiliated institution.
1. No Doctor-Patient Relationship
Use of this Site does not create a doctor-patient relationship between you and Dr. Brian P. Kelley or any other clinician. A doctor-patient relationship is established only through an in-person evaluation or another formal clinical encounter that satisfies applicable state law and professional standards.
Submitting an appointment request, completing a contact form, or communicating with us through any feature of this Site does not by itself establish a treatment relationship. Clinical care, when initiated, is provided through Dr. Kelley's clinical practice at the Institute for Reconstructive Plastic Surgery and affiliated facilities under the policies and procedures of those institutions. The clinic and hospital system must be contact directly. There are no actively monitored emails, addresses, or phone numbers associated with this informational site.
2. Educational Content Only
All content on this Site — including written articles, frequently asked questions, illustrations, videos, and references to peer-reviewed literature — is provided for general educational purposes. Articles on the Site are written and reviewed by Dr. Kelley. The content is not medical advice and is not a substitute for individualized evaluation by a qualified healthcare provider. Do not act, refrain from acting, delay seeking care, or modify any treatment plan based on information from this Site.
If you believe you may have a medical emergency, call 911 or go to the nearest emergency department immediately. Do not use this Site, the contact form, or any messaging feature to communicate emergencies.
Surgical candidacy, treatment planning, and clinical recommendations depend on factors specific to each patient — including medical history, examination findings, imaging, and personal goals — that cannot be assessed through a website. Outcomes data, recovery timelines, and risk figures discussed on this Site reflect published literature and typical ranges; they are not predictions or guarantees for any individual patient. Where this Site references Dr. Kelley's peer-reviewed publications, those references are provided as supporting literature for the educational discussion and not as a representation that any specific result will occur in any individual case.
3. Use of the Site
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You agree not to:
- Attempt to gain unauthorized access to any part of the Site, its servers, or any connected systems
- Use automated tools, bots, or scrapers to access or collect content from the Site without our express written permission
- Submit false, misleading, or fraudulent information through any form on the Site
- Upload or transmit any code, file, or content that is malicious, harmful, or designed to interfere with the Site
- Use Site content for unsolicited commercial purposes or for AI training that violates applicable terms
4. Patient Photographs and Educational Images
Photographs of patients displayed on this Site are published with the express written consent of each patient depicted. Consent for use of patient photographs on this Site has been documented separately from these Terms and is maintained on file.
Patient photographs are presented for educational purposes only. Surgical outcomes vary substantially based on individual anatomy, medical history, the specifics of each surgery, and post-operative care. No photograph on this Site should be interpreted as a guarantee, prediction, or representation that similar results will occur in any other patient. Comparable outcomes are not assured for any prospective patient, and a particular patient's likely result can be assessed only through individualized consultation.
Medical illustrations, diagrams, and other figures appearing on the Site are either created or edited by Dr. Kelley, or used under open-source licensing terms with attribution where required by the applicable license.
5. Intellectual Property
All content on this Site — including text, illustrations, videos, and design — is owned by ConMae Kelley Holdings, LLC or licensed to us, and is protected by United States copyright, trademark, and other intellectual property laws. Articles on the Site are written and reviewed by Dr. Kelley.
You may view, download, and print Site content for personal, non-commercial reference. You may not reproduce, republish, distribute, modify, or create derivative works from Site content without our prior written permission. You may not remove copyright notices, watermarks, or attribution from Site content.
References on this Site to Dr. Kelley's peer-reviewed publications, textbook chapters, professional society affiliations (such as the American Society of Plastic Surgeons or the American Society for Surgery of the Hand), academic appointments at Dell Medical School, or hospital privileges are made for educational and biographical purposes. These references do not imply endorsement of this Site by the cited journals, publishers, professional societies, academic institutions, or healthcare systems. The Site does not use the trademarks, logos, or proprietary content of Dr. Kelley's employer for marketing purposes.
6. Third-Party Links and References
The Site may link to or reference third-party websites and resources, including PubMed-indexed publications, professional society pages, and educational resources from organizations like the American Society of Plastic Surgeons. We provide these for convenience and educational context. We do not control these third-party resources, do not endorse their content, and are not responsible for their accuracy, availability, or privacy practices. Your use of any third-party resource is governed by that resource's own terms.
7. Geographic Scope and Licensure
Dr. Kelley is licensed to practice medicine in the State of Texas. The educational content on this Site is available to readers anywhere, but clinical evaluation and treatment are subject to applicable state licensure and telemedicine laws.
If you are not located in Texas and are interested in care, please contact the practice directly using the publicly listed telephone number to discuss whether and how an evaluation can be arranged. The availability of any clinical service to any individual depends on the laws of the state in which that individual is located at the time of the encounter.
This Site is not directed at residents of jurisdictions outside the United States, and any use of the Site from outside the United States is at your own risk.
8. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF CONTENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT INFORMATION ON THE SITE IS CURRENT, COMPLETE, OR ERROR-FREE. MEDICAL KNOWLEDGE EVOLVES OVER TIME, AND CONTENT ACCURATE AS OF ITS PUBLICATION DATE MAY NOT REFLECT CURRENT BEST PRACTICE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ConMae Kelley Holdings, LLC OR DR. KELLEY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS WEBSITE, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, OR USE.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR (A) PROFESSIONAL CARE PROVIDED OUTSIDE OF THIS SITE, (B) GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT, OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
Attorney review note: This clause is scoped narrowly to website-related claims and explicitly preserves all liability arising from the actual provision of clinical care (which is governed by malpractice law, professional standards, and your malpractice insurance — not by website T&C). Verify that this scoping is consistent with your malpractice carrier's policy provisions and any requirements your carrier has for website disclaimers.
10. Indemnification
You agree to indemnify and hold harmless ConMae Kelley Holdings, LLC and Dr. Kelley from any claim, demand, or damages — including reasonable attorneys' fees — arising from your violation of these Terms, your misuse of the Site, or your infringement of any third-party right.
11. Privacy
Your use of the Site is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Site does not collect information through forms, accounts, or messages. The Privacy Policy describes how we handle information collected automatically when you visit the Site, including analytics data, cookies, and server logs.
The Site is not a clinical communication channel. If you become a patient of the clinical practice through other means, the handling of your protected health information is governed by the Notice of Privacy Practices of the entity providing your care, not by this Site.
12. Modifications to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after a revision constitutes acceptance of the updated Terms.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
14. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Site.
